#TopContentChallenge#   Ethereum Approaches 10 Years of Uptime, But Critics Question Scalability and Legal Risks.

As ETHUSD approaches its tenth anniversary, community members have come together to highlight the network's decade-long resilience.

Ethereum kicked off the countdown to its tenth anniversary just over a week ago by unveiling an NFT torch, first held by co-founder Joseph Lubin.

Ethereum Has Been Online 10 Years

Ethereum announced that the countdown to its 10th anniversary has begun with the launch of an NFT torch that changes hands every 24 hours.

With just two days remaining for the event, excitement is building, with community members emphasizing the network's 10-year resilience.

Binji Pande, a contributor to the Ethereum Foundation and Optimism (OP), highlighted the network's track record, stating that it has operated for ten years without any downtime or maintenance windows.

“Ethereum has remained online for ten years without interruption or maintenance windows. Every centralized giant relies on on-call humans and planned outages.”

The contributor noted that Ethereum, unlike other networks, is unstoppable against various market forces and unlike networks that experience downtime during peak periods.

“…Ethereum never stops, despite forks, crashes, bubbles, lawsuits, attacks, wars, and every other drama the internet can throw at it,” the contributor added.

According to Binji, this track record is attributed to the Ethereum community, including developers, stakers, researchers, and users.

Critics Question Ethereum's Uptime Narrative and Legal Underpinnings

Analyst Marty Party challenged this view, pointing to the slow speed of the Ethereum network and its L2 infrastructure. He also argued that Ethereum's uptime record is misleading, with L2s being centralized, escrow-bound proxies.

"Stop sugarcoating the facts. At 13 tps, it's slow and unusable. L2s aren't the blockchain, they're just centralized sorters that collect, compress, and write bogus "transactions" to Ethereum with a 7-day escrow window," the analyst challenged.

He noted that most assets are unregistered securities, especially on platforms like Hyperliquid, and suggested waiting for new US crypto laws to clarify what constitutes legality.

In particular, Hyperliquid has a native bridge to Ethereum and is designed to be compatible with the Ethereum Virtual Machine.

“I would wait until the Market Structure Law and the Clarity Law finalize the guidelines before contributing large amounts to Ethereum L2s,” he warned.

Despite this, the countdown to Ethereum’s tenth anniversary continues, and reports suggest that Ukraine’s Deputy Minister of Digital Transformation, Alex Bornyakov, is the current owner of the Ethereum Torch NFT.

Previous holders of the Ethereum NFT Torch include Joseph Lubin and Michael Egorov.

A rotating cast of prominent community figures and developers will hold the torch for 24 hours, starting July 20.

Ethereum was trading at $3,848, up more than 2.3% in the last 24 hours, amid growing institutional interest.
